HOW TO RE-SHARE INSTAGRAM POSTS WITHOUT A BIG FAT LAW SUIT SLAPPED ON YOUR ASS
April 27, 2020
If you share other people’s content, you’re not only violating Instagram’s Terms of Use (which means they could close your account down), but you’re also violating Copyright Law.
This is a very scary and expensive mess to clear up (especially as a small business), so it’s best to avoid it in the first place… for your pockets and your integrity’s sake!

WHY?

The loudest alarm bells start ringing when sharing someone else’s content (both text copy and images) because of the copyright ownership. The creator of the post person owns the copyright and as such owns the right to any revenue or benefits afforded by that content.

Before any content is shared, we must obtain permission.

TYPES OF PERMISSION

Implied Permission

This is where the permission is ‘implied’ (no shit Sherlock!).

So, if you were running a competition or a campaign where the entrants needed to use a specific branded hashtag to enter their image, they are implying their permission for that content to be shared.

This is a great thing and would usually be enough to protect yourself from Copyright Law… but isn’t water tight!

Explicit Permission (not the top shelf kind, mind!)

Move over margaritas… explicit permission is the juice you want to get a whole pitcher of! 🍹

Here, the original content creator gives you clear and direct permission to repost their content onto your Instagram feed.

I recommend you get this each and every time. Not only are you covering your ass, you’re also starting to build up an authentic relationship with other ‘grammers #collabs

HOW TO GET EXPLICIT PERMISSION

This IS NOT difficult!

Option 1:

Comment on the original post with something like this – “Hey, I really resonate with this, is it OK to share this on my feed?”. Then screen shot their reply saying yes… ya know, for future reference if it’s needed.

Option 2:

Send the original content creator a DM saying some like – “Hey, I loved your post yesterday (describe post), I’d love to share it on my feed… is that OK?”

Either way you will receive a yes or no answer… which a) covers your ass, b) protects your integrity and c) could possibly start a blossoming relationship! Winner, winner all round!

ONCE YOU HAVE EXPLICIT PERMISSION

Again… we have two options:

Option 1:

Use an approved Instagram Partner app that allows you to repost (make sure they’re an approved partner otherwise you run the risk of your whole operation getting shut down… not ideal!).

Option 2:

Screen shot the post and share it as normal.

⚠️ I STRESS AGAIN HERE… YOU MUST HAVE PERMISSION BEFORE DOING EITHER OF THESE AND…

TAG THE ORIGINAL CONTENT CREATOR IN BOTH INSTANCES! ⚠️
